Terms & Conditions

Please read these terms carefully before using FinPe's platform and services.

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("Partner", "Retailer", "Distributor") and DSEWA SERVICES INDIA PRIVATE LIMITED FinPe, governing your access to and use of the FinPe platform, mobile application, and all related services.

1. Acceptance of Terms

By registering for an account, accessing, or using any FinPe service, you confirm that you have read, understood, and agree to be bound by these Terms, along with our Privacy Policy and any additional guidelines or rules applicable to specific services.

If you are accepting these Terms on behalf of a company, partnership, or other legal entity, you represent that you have the authority to bind that entity to these Terms.

If you do not agree to any part of these Terms, you must immediately discontinue use of the FinPe platform and services.

2. Our Services

FinPe provides a technology-enabled platform that allows registered partners to offer the following digital and financial services to end customers:

  • AEPS (Aadhaar Enabled Payment System) — Cash withdrawal, balance inquiry and mini-statements via biometric authentication.
  • Domestic Money Transfer (DMT) — Instant fund transfers to any bank account in India via IMPS, NEFT, and UPI rails.
  • Indo Nepal Money Transfer — Cross-border remittance to Nepal.
  • Bill Payments & Recharges (BBPS) — Mobile, DTH, electricity, gas, water, FASTag, EMI and other utility payments.
  • Micro ATM — Cash withdrawal and balance inquiry using any debit card on a portable POS device.
  • PAN Card Services — New PAN application, corrections, and e-PAN downloads as an authorised NSDL/UTI sub-agent.
  • Insurance — Motor, health, life, and travel insurance products from authorised insurers.
  • Travel Bookings — IRCTC train tickets, flights, buses, and hotel reservations.

FinPe reserves the right to add, modify, suspend, or discontinue any service at any time, with reasonable notice where practicable.


3. Eligibility

To register and use the FinPe platform you must:

  • Be at least 18 years of age.
  • Be a citizen or legal resident of India.
  • Possess a valid Aadhaar number and PAN card.
  • Operate a legitimate retail or business establishment capable of rendering the services offered.
  • Not be a person barred or prohibited from entering into contracts under any applicable law.
  • Comply with all applicable laws and regulations governing financial and payment services in India.

4. Your Account

Upon successful registration and KYC verification, FinPe will create an account ("Partner Account") for you on the platform. You are responsible for:

  • Keeping your login credentials (username, password, MPIN, OTP) strictly confidential.
  • All activities that occur under your Partner Account, whether authorised by you or not.
  • Notifying FinPe immediately at support@finpe.net of any unauthorised access or security breach.
  • Ensuring that your account details, business information, and contact information remain accurate and up to date.
FinPe will never ask for your password, MPIN, or OTP over phone, email, or chat. Do not share these with anyone, including FinPe staff.

5. KYC & Regulatory Compliance

FinPe operates under licences and authorisations issued by the Reserve Bank of India (RBI) and other regulatory bodies. As a registered partner you agree to:

  • Complete eKYC verification using Aadhaar-based biometric authentication or OTP verification before activation.
  • Provide accurate, current, and complete KYC documents including Aadhaar, PAN, and proof of business.
  • Comply with all Anti-Money Laundering (AML) and Combating the Financing of Terrorism (CFT) requirements as mandated by PMLA 2002 and RBI guidelines.
  • Perform customer due diligence (CDD) on end customers before processing transactions as required.
  • Maintain transaction records for a minimum of five (5) years as required by law.
  • Report suspicious transactions to FinPe's compliance team immediately.

Failure to comply with KYC and regulatory obligations may result in immediate suspension or termination of your Partner Account.


6. Transactions & Settlements

All transactions processed through the FinPe platform are subject to the following conditions:

  • Transaction limits are set by FinPe and/or the relevant regulatory authority and may be revised at any time with notice.
  • Settlements to your Partner Wallet are processed in near real-time, subject to network availability and banking system cutoff times.
  • FinPe does not guarantee the success of any transaction and shall not be liable for failures attributable to third-party systems, bank downtimes, or network outages beyond our control.
  • Failed transactions will be reversed within the timeline prescribed by the applicable payment network (typically T+1 to T+3 business days).
  • You must verify all transaction details (amount, beneficiary account, mobile number) before initiating a transaction. Errors resulting from incorrect details entered by you are your sole responsibility.
  • FinPe reserves the right to hold, delay, or reverse any transaction suspected of fraud, money laundering, or regulatory non-compliance.

7. Fees, Commissions & Charges

Your earnings on the FinPe platform are based on the commission structure communicated to you during onboarding and updated from time to time in the Partner Portal.

  • Commission rates vary by service, volume tier, and partner category (Retailer / Distributor / Master Distributor).
  • FinPe may deduct applicable GST, TDS, or any other statutory levy from commissions as required by law.
  • Any chargeback, reversal, or penalty imposed on FinPe by a payment network due to your actions may be recovered from your Partner Wallet.
  • Wallet top-ups, if applicable, may attract a processing fee as indicated in the Partner Portal.
  • FinPe reserves the right to revise fee and commission structures with 15 days' prior notice via the Partner Portal or registered email.

8. Prohibited Activities

You agree not to use the FinPe platform for any of the following:

  • Processing transactions that are fraudulent, fictitious, or involve stolen credentials or accounts.
  • Money laundering, hawala transfers, or any activity violating PMLA 2002 or FEMA 1999.
  • Circumventing transaction limits by splitting large amounts into multiple smaller transactions (structuring).
  • Accessing or attempting to access another partner's account without authorisation.
  • Using automated scripts, bots, or other means to interfere with platform operations.
  • Reselling your Partner Account credentials or allowing unauthorised third parties to use your account.
  • Processing transactions for goods or services prohibited under Indian law.
  • Providing false information during registration, KYC, or any compliance process.
Violation of any prohibited activity may result in immediate account suspension, forfeiture of outstanding commissions, and reporting to law enforcement authorities.

9. Limitation of Liability

To the maximum extent permitted by applicable law:

  • FinPe provides the platform on an "as-is" and "as-available" basis without warranties of any kind, express or implied.
  • FinPe shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform.
  • FinPe's aggregate liability for any claim arising under these Terms shall not exceed the total commissions earned by you in the three (3) calendar months immediately preceding the event giving rise to the claim.
  • FinPe shall not be held responsible for losses arising from force majeure events including natural disasters, strikes, power outages, cyber-attacks on third-party systems, or government actions.

10. Privacy & Data Protection

Your use of the FinPe platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the platform you consent to the collection, processing, and use of your personal and business data as described therein.

  • We collect only the data necessary to provide services, comply with regulations, and improve the platform.
  • End-customer data processed through your account remains confidential and must not be misused or shared with unauthorised parties.
  • Biometric data processed via AEPS is handled exclusively by the UIDAI-authorised ecosystem and is never stored by FinPe.
  • We implement industry-standard security measures including PCI-DSS compliance and bank-grade encryption (TLS 1.2+).

11. Suspension & Termination

Either party may terminate the partnership at any time:

  • By you: Submit a written termination request to support@finpe.net. Outstanding commissions will be settled within 30 business days after verification, subject to any pending disputes or chargebacks.
  • By FinPe (with notice): We may suspend or terminate your account with 15 days' notice for business or regulatory reasons.
  • By FinPe (immediate): We may suspend or terminate your account immediately if you violate these Terms, engage in fraudulent activity, or fail KYC/compliance requirements.

Upon termination, your access to the platform will be revoked and all pending transactions will be processed per our standard settlement cycle.


12. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any dispute, controversy, or claim arising out of or relating to these Terms shall be resolved as follows:

  • Amicable Resolution: Both parties agree to first attempt to resolve disputes through good-faith negotiation within 30 days of the dispute arising.
  • Arbitration: If negotiation fails, disputes shall be referred to binding arbitration under the Arbitration and Conciliation Act, 1996, with a sole arbitrator mutually appointed by the parties.
  • Jurisdiction: The courts of New Delhi, India shall have exclusive jurisdiction for any matters not resolved through arbitration.

13. Amendments to These Terms

FinPe reserves the right to update or modify these Terms at any time. When we make changes:

  • The revised Terms will be posted on the FinPe website and Partner Portal with the updated "Last Updated" date.
  • For material changes, we will notify you via your registered email or an in-app notification at least 15 days before the changes take effect.
  • Your continued use of the platform after the effective date of any amendment constitutes your acceptance of the revised Terms.
